Case Significance

Public Prosecutor v Tan Sen Yang [2024] SGHC 201 was a grounds of decision of the General Division of the High Court delivered by Aedit Abdullah J on 8 August 2024 in Criminal Case No 43 of 2023, following hearings across 3 to 6 and 10 to 12 and 31 October 2023, 13 February and 25 April 2024. The accused, Tan Sen Yang, was charged with the murder of the deceased, Satheesh Noel s/o Gobidass, in an altercation that occurred at Orchard Towers on 2 July 2019 at about 6.25 a.m. at level one of No 400 Orchard Road, pursuant to s 300(c) of the Penal Code (Cap 224, 2008 Rev Ed), punishable under s 302(2).

After considering the evidence and the parties' submissions, the court was satisfied that the charge had been established beyond a reasonable doubt and convicted the accused accordingly, sentencing him to life imprisonment. The catchwords reflect that the case engaged the special exceptions of sudden fight and diminished responsibility. The grounds, which expanded on the oral judgment delivered on 25 April 2024, were issued because the accused had appealed against his conviction.
