Case Significance

Lim Chun Yong (alias Lin Junxiong) v Yap Jeffrey (alias Yap Kean Hui) and others [2024] SGHC 150 was a reserved judgment of the General Division of the High Court of Singapore delivered by Wong Li Kok, Alex JC on 10 June 2024, in Suit No 153 of 2021, following hearings across October and November 2023 and on 2 February 2024. The suit arose from a chain collision involving three motor vehicles in Malaysia that left the accident victim, Mr Lim Chun Yong (Lin Junxiong), with severe injuries including permanent brain injuries. Mr Lim, who was 44 years old as of the date of judgment, resided in a nursing home and sued through his wife and deputy, Ms Janet Fung Wui Mang. The defendants were the three drivers of the vehicles involved, the employer of one of the drivers and the owner of one of the vehicles: Jeffrey Yap @ Yap Kean Hui, Liew Loy Sang, Low Woon Hong, Mohd Jafri bin Abdul Hamid, Syarikat Continent Lorry Transport Sdn Bhd, and AmGeneral Insurance Berhad (formerly known as Kurnia Insurans (Malaysia) Berhad). The insurer of the vehicle driven by the first defendant was given leave to participate. The catchwords covered tort (motor accidents and negligence), the assessment, computation and measure of damages in personal injury cases, and civil procedure relating to experts.
