Summary
Masri bin Hussain, convicted of possessing not less than 23.86g of diamorphine for trafficking and sentenced to death, applied to adduce fresh evidence on appeal to pursue a 'Partial Consumption Defence' — that while the drugs were mainly for personal use, he was open to selling some. This was wholly inconsistent with his trial defence that all the drugs were entirely for personal consumption. The Court of Appeal dismissed the application as an abuse of process, finding it was effectively an attempt to obtain a retrial with a new and inconsistent defence.
