Case Significance

In WZN v WZM [2024] SGHCF 41, decided on 6 November 2024, the General Division of the High Court (Family Division) heard District Court Appeal No 36 of 2024, with Kwek Mean Luck J delivering the grounds of decision after hearing the matter on 17 October 2024. The appeal arose from the District Judge's decision in FC/D 3276/2018 (Summons No 2582 of 2020), where the District Judge had rescinded the respondent mother's spousal maintenance but made no change to the quantum of the child's maintenance order. The appellant father argued that the rescission of the mother's maintenance should be backdated and that the child's maintenance should be varied and similarly backdated, with a key issue being whether he was barred by issue estoppel from seeking a variation because of earlier enforcement orders for maintenance arrears. At the end of the hearing Kwek Mean Luck J found that the father was not barred by issue estoppel, reduced the quantum of the child's maintenance order, and backdated both the rescission of the mother's maintenance and the variation of the child's maintenance to the date Summons No 2582 was filed.
